Dump cited over school demolition debris



A lawyer for M & amp;M Demolition of Vienna said the company will correct the problem.
WARREN -- A Trumbull County school demolition project has produced a citation from the Trumbull County Health Department for accepting improper school demolition debris.
Health Commissioner Dr. James Enyeart confirmed this week that his department issued the citation to Charles McGill, owner of McGill Septic Tank Co. on State Road in Kinsman for material it received from buildings being demolished as part of an Ohio Schools Facilities Commission project for the Joseph Badger Local School District.
Enyeart said the business accepted what the department would classify as construction demolition debris, which Ohio law requires to go to a construction demolition debris landfill.
The citation, issued March 13, requires McGill to remove the material within 30 days.
Atty. Bob Burkey of Warren, who represents the Hartford Township trustees, said he called the matter to the health department's attention because it appeared that the material had been dumped improperly from the former Hartford Elementary. The township owns the land where the school was located.
'Curable' problem
But Atty. Bob York of Warren, who represents M & amp;M Demolition of Vienna, which is in charge of the demolition projects, said the material taken to McGill's property came from the buildings being demolished in Gustavus and Vernon townships. A building in Kinsman has also been removed. The district's new K-12 building opened in Vernon in September.
In any event, York said he believes M & amp;M will fix the problem without much trouble.
"Is there a possibility that we committed a violation? Yes, but it is curable," he said.
Enyeart said clean, hard fill from such a demolition can be used to build driveways and such if it contains bricks, block, concrete and asphalt. Demolition material that contains other materials, such as wood, can only be taken to a licensed construction demolition debris landfill.
The county health department cited several property owners in May 2006 for improperly accepting construction demolition debris that had come from the former LaBrae High School site on West Market Street.
