Forum files suit against U.S. Health & Human Services

YOUNGSTOWN — The operating company for Northside Medical Center is suing the federal government over Medicare payments in 2003.

Western Reserve Care System, which is part of Forum Health, filed the suit today in U.S. District Court in Youngstown against Michael Leavitt, secretary of the U.S. Department of Health and Human Services.

The suit is an appeal of his decision on payments made to Western Reserve for care given to Medicare patients.

It isn’t known how much money is in question because payments for all Medicare patients that year would have to be recalculated if the suit is successful, said Jim Flynn, an attorney at a Columbus law firm that is representing Western Reserve.
