Man says he was insane



Two months are allotted to determine whether he's competent to stand trial.
WARREN -- A 32-year-old Hubbard man charged with nine counts of rape, involving a girl when she was 3 and 6, will be attempting to use an insanity defense.
Atty. Anthony Consoldane of the Ohio Public Defender's Office told Judge W. Wyatt McKay of Trumbull County Common Pleas Court that he intends to file documents saying Timothy M. Gaut pleads innocent by reason of insanity.
Consoldane asked Wednesday that an evaluation be done on Gaut to determine whether he is competent to stand trial. His next hearing was set for April 11 to provide enough time for the evaluation.
After Gaut's arraignment two weeks ago, Mike Burnett, an assistant county prosecutor, said he believes Gaut was sane when a variety of crimes were committed on the Internet last month; and when sexual acts occurred against the girl in 2003, 2006 and 2007.
Gaut, in Trumbull County Jail with bond set at 1 million, did not appear for Wednesday's hearing, waiving his right to be present, Consoldane said. The rape charges carry a possible life prison sentence.

Hubbard police arrested Gaut on Jan. 28 at the Gary Drive home he shared with his parents and a 6-year-old girl, after Gaut was snared in a sting operated by the Fairfaix County (Va.) Police Department's Internet Crimes Against Children Task Force.
A task force detective and a federal officer posed as a father and his 11-year-old stepdaughter in the sting. Gaut's indictment said he asked the federal officer whether he could perform various sex acts on her, and sent a video of himself masturbating.
He also sent a video of him engaging in sexual conduct with a 6-year-old girl, which caused federal officials to contact Hubbard police immediately.
Evidence gathered from Gaut's computer also led to his being charged with 10 counts of pandering obscenity, which relate to Internet activity, Burnett said.
