Insanity defense in child rape case


WARREN — A 32-year-old Hubbard man charged with nine counts of rape, involving a girl when she was 3 and 6, will be attempting to use an insanity defense.

Atty. Anthony Consoldane of the Ohio Public Defender’s Office told Judge W. Wyatt McKay of Trumbull County Common Pleas Court that he intends to file documents saying Timothy M. Gaut pleads innocent by reason of insanity.

Consoldane asked Wednesday that an evaluation be done on Gaut to determine whether he is competent to stand trial. His next hearing was set for April 11 to provide enough time for the evaluation.
