Officer accused of assault



The woman told police the officer struck her several times.
AUSTINTOWN -- A township police officer is being investigated after a woman accused him of forcing sex on her and hitting her.
The officer has not been charged. He was not on duty during the time his actions are in question.
The woman, 34, filed a report with police saying the assault happened Tuesday around 8 p.m. in a hotel room at the Fairfield Inn on North Niles-Canfield Road.
The woman told police she has been seeing the officer for two years, and on Monday, the two had consensual sex in the hotel room.
Allegations
The woman said that on Tuesday, she went to the emergency room at St. Elizabeth Health Center because she wasn't feeling well. She was given medication and returned to her hotel room. She said the officer came to the room again and wanted to have sex, but she told him no because she wasn't well and had taken the medication, according to the report.
She said he indicated he didn't care and forced himself on her, holding her arms down the entire time.
Afterward, he got angry because he saw an engagement ring on her finger and struck her in the back as she was walking away from him, knocking her to the floor, she told police. She said he struck her several more times before leaving the room.
The woman filed her report with police Wednesday. She was asked if she would consent to a rape kit at St. Elizabeth's and if she wanted to pursue the matter, and she said yes. She was taken to St. Elizabeth's, and the hospital is to contact the police department when the test is complete.
Chief Robert Gavalier said that while the investigation continues, the officer is on paid leave. The state Bureau of Criminal Investigation is assisting in the investigation because it concerns one of the department's own officers and "we want to be impartial," Gavalier said.
