SAGINAW, Mich. -- Daniel Foster, above on stretcher, remained hospitalized in critical condition Friday, a day after reportedly being shot in the chest by a 15-year-old classmate. Security guards used a metal detector to search Saginaw High School students Friday. Clarence W. Russell III was charged as an adult Friday with assault with intent to murder and five felony firearms charges in the shooting. Surgeons determined the bullet didn't hit any of Foster's organs, police said. "Hopefully he's going to be all right," police Sgt. Mark Lively said. The boys' high school has grappled with several violent occurrences in the past year, and authorities said they believe the lunch-hour shooting inside the school may have been gang-related. Saginaw County Prosecutor Michael D. Thomas would not say how authorities believed gangs were involved. "I didn't know what to think of it," said ninth-grader Lashunta Cole, 14, who was in math class when the shooting happened one floor above her. "It was crazy."
Laci Peterson's motherto receive life insurance
FRESNO, Calif. -- A judge ruled Friday that proceeds from a $250,000 life insurance policy Scott Peterson took out on his wife, Laci, will go to her mother instead. Because Scott Peterson was convicted of killing his pregnant wife, Stanislaus County Superior Court Judge Roger Beauchesne said he is not entitled to collect the benefits of her life insurance policy. Under state law, criminals cannot profit from their crimes. The judge said the money should go to the executor of Laci Peterson's estate, her mother, Sharon Rocha. Neither Rocha, who had petitioned the court, nor Scott Peterson's attorney could be reached to comment Friday. Scott Peterson was sentenced to death earlier this year for killing his wife and their unborn son. Their bodies were found on the shore of San Francisco Bay months after her December 2002 disappearance.
Bomb scare at Capitol
WASHINGTON -- A young man was taken for a psychiatric examination Friday after telling police there was a bomb in his car in front of the Capitol. Police exploded a package inside the vehicle as a precaution. The unidentified driver and a passenger parked near the corner of First Street and Constitution Avenue. The heavily traveled area was sealed off shortly before 11 a.m. after the driver told police he had a bomb. A bomb squad member used a mirror to examine the underside of the car. Later, police blew up whatever was inside, causing a flash and loud noise and blowing open a back door. "We were able to go in and safely examine the package in question, and it contained inert materials, nothing of any danger," Assistant U.S. Capitol Police Chief James Rohan said.
Mother pleads innocentto murdering 3 children
SAN FRANCISCO -- The woman seen dropping her young sons into San Francisco Bay pleaded innocent Friday to three counts of murder. Lashuan Harris, described as mentally ill by family members, kept her head down and held her public defender's hand through most of the brief court hearing. She quietly answered "yes" when the San Francisco Superior Court judge asked if she was willing to waive her right to a speedy preliminary hearing. Harris, 23, faces three counts of murder with the "special circumstance" of multiple murder. A claim of special circumstances means a murder defendant could be eligible for the death penalty, but San Francisco District Attorney Kamala Harris said she hasn't yet decided on whether to seek such a sentence.
Teen charged as an adultin death of attorney's wife
MARTINEZ, Calif. -- A 16-year-old neighbor accused of killing the wife of a prominent defense attorney was charged with murder Friday and ordered held in lieu of $1 million bail. He was charged as an adult. Scott Dyleski did not enter a plea or speak during his first court appearance since his arrest in the Oct. 15 beating death of Pamela Vitale, whose body was discovered by her husband at the couple's hilltop estate. Vitale and her husband, defense lawyer and TV legal pundit Daniel Horowitz, were building their dream home in the wealthy suburb of Lafayette, about 20 miles east of San Francisco. Dyleski lived down the hill from them with his mother.
