Couple avoids jail sentence by paying $125,141

WARREN -- A Cortland woman and her husband avoided being sent to jail for contempt of court by paying $125,141 to the administrator of the estate of a deceased woman to whom the Cortland woman gave nursing services.
Marlene E. Shamrock, 59, and Paul Shamrock Sr., of Griffith Drive Northeast, paid the money one hour before their sentences were to begin last Friday, said Atty. Randil J. Rudloff, administrator of the estate of Mary Cheroka. OK The Shamrocks paid the money to him, Rudloff said.
This week, Rudloff filed an motion with the Trumbull County Probate Court indicating the payment.
On Dec. 2, Probate Judge Thomas A. Swift ruled that the Shamrocks could avoid incarceration for contempt of court by paying the amount by noon Dec. 23 and providing a full accounting of all of the assets Marlene E. Shamrock received from Cheroka and how the assets were distributed.
Marlene E. Shamrock formerly operated Shamrock Med Staffing Inc. She pleaded guilty to a felony theft charge last year and served 60 days in jail. She will also serve a five-year probation in connection with the case.
Prosecutors said Shamrock stole $135,000 from Cheroka, an elderly Mecca woman.
As part of the sentence, Judge W. Wyatt McKay of Trumbull County Common Pleas Court ordered that Shamrock not have any further contact with the elderly or disabled.
The state also revoked Marlene E. Shamrock's nursing license.
