Plaintiff files motion to overturn verdict
YOUNGSTOWN -- A plaintiff who unsuccessfully sued a Youngstown teacher and the school district for failing to report alleged child abuse is seeking to have the verdict overturned or a new trial.
Lawyers for Donald T. Kraynak, on behalf of his now 15-year-old son, argued in a motion filed Monday that the jury -- which voted 6-2 for the defense and awarded no damages -- disregarded the facts and law. Earlier this month, a jury returned a verdict on behalf of the Youngstown City School District and teacher Helen Marino.
A defense attorney said the jury determined that Marino wasn't negligent by not reporting the alleged abuse by the youth's mother and that she didn't violate the state's child abuse reporting statute. Because negligence wasn't established, the jury did not award any money to the plaintiff.
