YOUNGSTOWN -- A former city street department superintendent has filed a request in Mahoning County Common Pleas Court to have records of his criminal conviction sealed from public view.
William Dundee pleaded guilty in July 1997 to theft-in-office. Authorities said he took $2,100 in city scrap metal proceeds. In December 1997, he was sentenced to 30 days in the county jail and 200 hours of community service. He was fined $1,000 and ordered to make restitution of $2,100.
Put on probation
A five-year prison sentence was suspended, and he was placed on probation for three years.
Dundee, 56, whose address is listed as Green Beaver Road, Canfield, spent about eight hours in jail before being released because he couldn't take his required medication. Visiting Judge Tommy L. Thompson imposed more community service time instead.
In a document filed Friday, Dundee says he has completed his probation, has no other criminal convictions on his record and has no criminal charges pending against him.
For those reasons, the retired street superintendent is asking Judge Robert Lisotto to order his criminal case file sealed.
In 1999, Dundee filed a motion asking that his probation be terminated 18 months early. He said he had paid his fine and had done his community service with the Rescue Mission of the Mahoning Valley.
He also wanted permission to carry a firearm, which convicted felons are not allowed to do in Ohio. Judge Thompson denied the requests.
