Garcia's blood alcohol level way over limit



SAN JOSE, Calif. (AP) -- San Francisco 49ers quarterback Jeff Garcia had a blood-alcohol level nearly three times the legal limit when police pulled him over earlier this month, according to court papers released Thursday.
The police report and complaint said that Garcia, arrested on suspicion of drunken driving Jan. 14, had a blood alcohol level of more than .20 when he was arrested near San Jose State University.
The legal limit in California is .08. Police administered two field tests: The first registered .237 and the second .219, Santa Clara County prosecutor Lisa Rogers said.
The 33-year-old Garcia faces a maximum sentence of six months in jail if he's convicted of the misdemeanor charges filed against him, Rogers said. If he pleads guilty or no contest, he could get 10 to 15 days of weekend work, a typical sentence for first-time offenders, she said.
On his Web site this week, 49ers wide receiver Terrell Owens bashed Garcia, saying he would rather play alongside a better quarterback elsewhere. He also poked fun at Garcia's arrest, saying that if the quarterback came to his Super Bowl party he would dispatch a limousine to make sure Garcia got home safely.
And, in a radio interview Thursday, Owens called his chances of returning to the 49ers "gloomy" and put the Philadelphia Eagles, Atlanta Falcons and Baltimore Ravens high on his wish list.
