Judge grants continuance in murder case

Friday, August 30, 2002

WARREN -- The competency hearing for a woman accused of aggravated murder in the death of her 6-year-old daughter has been continued until Sept. 25.
Sherry Delker, 27, of Austintown, is charged with the March 29 death of her daughter, Samantha Martin. If convicted, she could face the death penalty.
A competency hearing had been set for Thursday for Delker before Judge John M. Stuard of Trumbull County Common Pleas Court, but her attorney, Anthony Consoldane of the Trumbull County Public Defender's Commission, requested a continuance.
Consoldane said he wants all three doctors who examined Delker to attend the hearing, but they couldn't all attend a hearing Thursday.
Authorities say Delker ran over her daughter with her car on Prospect Street near state Route 46 in Mineral Ridge, next to St. Mary Church.
Consoldane contends Delker suffers from a mental illness. The judge ordered that three experts, one chosen by the defense, prosecution and the court, each examine Delker and issue a report to the court.
