Magistrate to considerTraficant's motion
CLEVELAND -- The federal judge presiding over U.S. Rep. James A. Traficant Jr.'s racketeering case has referred to U.S. Magistrate Judge William H. Baughman a motion Traficant filed to suppress evidence, based on immunity granted him in the speech or debate clause of the Constitution.
Traficant of Poland, D-17th, has objected to evidence related to his office that prosecutors intend to use at his Feb. 4 trial.
The magistrate "shall consider the motion and shall file a report and recommendation for its disposition," U.S. District Judge Lesley Brooks Wells said in an order filed Thursday.
