Poor sewer system blamed for flooding



WARREN -- An Austintown business says Liberty Township, Trumbull County and the state are to blame for flooding problems on its Belmont Avenue property.
West End Investment Co., Javit Court, filed suit this week in Trumbull County Common Pleas Court, saying the three entities have been negligent with a sewer system on the land.
The case is assigned to Judge W. Wyatt McKay.
The company says flooding occurs regularly during rain storms on its property at 2800 and 2850 Belmont Ave.
The lawsuit says the sewer system failed, causing extensive flooding throughout the property because the system is negligently designed, constructed, operated, maintained and controlled.
Severe water damage resulted, ruining equipment, inventory and personal property and rendering the property unusable, the lawsuit says.
West End is asking for damages in excess of $50,000, plus interest, legal costs and other fees. It also wants the court to force the three entities to repair, redesign or properly maintain the system to prevent further flooding.
