Man faces assault charge in shooting case



YOUNGSTOWN -- Police charged Frank Emerson, 30, of Valerie Drive with felonious assault, saying he shot Travis Marriotti during a dispute Saturday evening. The shooting occurred at Emerson's home.
A police report says Marriotti told police he went to the residence to speak with his girlfriend, but people there wouldn't let him. Marriotti went back to his car to leave. Emerson pulled up in his car behind Marriotti's. Marriotti told police Emerson tried to get in his car, but it was locked. Emerson shot into the car through the passenger window once, hitting Marriotti in his hip.
Emerson, however, told police Marriotti had been stalking the woman, who is now his girlfriend. He said Marriotti walked into the home with a gun, saying he was going to shoot her.
Emerson told police he chased Marriotti out of the home and into the front yard, where they fought, causing Marriotti to drop the gun. Emerson said he picked it up and fired a warning shot, accidentally hitting him. Emerson said he didn't intend to hurt Marriotti, that it was accidental.
Police took Emerson to the Mahoning County Jail. Marriotti, whose address was not on the report, was treated at St. Elizabeth Health Center.
