MAHONING COUNTY Judge to rule on revoking bond

YOUNGSTOWN -- A decision is pending in Mahoning County Common Pleas Court, where prosecutors want to revoke a city man's bond and put him in jail to await trial for felonious assault.
James A. Dimuzio, 40, of Melrose Avenue, and his twin brother, Anthony J. Dimuzio of Coral Sea Drive, were indicted on identical charges in March 2001. James Dimuzio is a Youngstown fireman.
The brothers are accused of beating up Edward T. Saadi, an attorney, in the restroom of a Boardman restaurant in January 2001.
Saadi has filed a civil lawsuit against the Dimuzios, which is pending in common pleas court.
James Dimuzio has been free on bond awaiting trial on the felonious assault charge, which is scheduled for June 5. Prosecutors filed a motion to revoke his bond and make him wait for trial in jail because of another assault complaint lodged against him last month.
Basis of charge
Matthew Romeo of Austintown said he and the Dimuzios were working on a construction job together, pouring a concrete driveway, when a dispute arose between him and James Dimuzio. Romeo said Dimuzio tried three times to head-butt him, connecting once to his chin.
At a hearing Monday, two witnesses who were working at the site said they saw the men arguing but that Dimuzio never struck, or even attempted to strike, Romeo.
"There was no physical contact at all," said Joseph Chance of Youngstown, who said he is Romeo's second cousin. The other witness was Brian Cox, a cement contractor who was working with the men that day.
Romeo said the argument was over who was going to pay for the cement.
Judge Robert Lisotto took the matter under advisement and said he will rule later.
